Please read these Terms of Service (“Terms”) carefully before using any services provided by Got Lucky Labs LLC. (“Company,” “we,” “us,” or “our”). These Terms govern your access to and use of our at-home test kits, digital platforms (including our website and mobile application), and any related services or content (collectively, the “Services”).

By using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use our Services.

1. Eligibility

You must be at least 18 years old to purchase or use our Services. By accessing or using our Services, you represent and warrant that you meet this eligibility requirement and that the information you provide is accurate and complete.

2. Purpose of Services

Our at-home test kits and digital services are designed for informational and screening purposes only. They are not intended to diagnose, treat, or cure any medical condition and are not a substitute for professional medical advice.

Test results should be reviewed in consultation with a licensed healthcare provider. You are solely responsible for any decisions made based on your results.

3. Test Kit Use and Return Policy

Non-Returnable: Due to health and safety regulations, once a test kit has been shipped, it is non-refundable and cannot be returned, even if unused or unopened.
Replacement Policy: We will provide a replacement kit at no cost in the following cases:
- The kit arrives damaged, defective, or incomplete (must be reported within 10 days of delivery).
- The laboratory is unable to process your sample due to a verified collection error.
- The order was not received within 10 business days of confirmation, and shipping issues are confirmed.
Customer Responsibility: You are responsible for properly registering your test kit, collecting your sample as instructed, and returning it prior to its expiration date. Kits that are unregistered, improperly collected, or expired are not eligible for processing or replacement.

4. User Accounts and Access

To access certain features of the Services, including digital test results, you may be required to create a user account. You agree to:

Maintain the security of your login credentials
Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate your account for violations of these Terms or misuse of our Services.

5. Privacy and Data Protection

We are committed to protecting your privacy and handling your information in compliance with applicable laws, including HIPAA (where applicable). Our practices regarding the collection, use, and disclosure of your information are outlined in our [Privacy Policy].

We do not sell or share your personal health information without your consent, except as required to deliver services or comply with legal obligations.

6. Intellectual Property

All content, software, trademarks, and design elements associated with the Services are the property of Got Lucky Labs LLC. or its licensors. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

7. Service Modifications and Availability

We may, at any time and without liability, modify, suspend, or discontinue any part of the Services, including availability of features, delivery timelines, or access methods. While we aim to maintain uninterrupted service, we do not guarantee continuous or error-free operation.

8. Limitation of Liability

To the maximum extent permitted by law, Got Lucky Labs LLC. and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

Our total liability for any claim arising out of or related to the Services shall not exceed the amount paid by you for the specific test kit or service in question.

9. Dispute Resolution

Any dispute shall be resolved by binding arbitration conducted by JAMS in accordance with its Streamlined Arbitration Rules and Procedures., under the laws of the state of California.

You waive the right to participate in any class action or representative proceeding.

10. Changes to Terms

We reserve the right to update or modify these Terms at any time. When changes are made, the "Effective Date" at the top will be updated. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
